The services provided by Redpoint Consulting Limited ("Redpoint") through the Website ("Service" or "Services") and the use of the Website are governed by these Terms and Conditions ("Terms and Conditions"). By accessing or using the Services or the Website or by registering as a bidder ("Bidder" or "User"), you agree that

  1. You have read the Terms and Conditions,
  2. You understand the Terms and Conditions, and
  3. Your use of the Services and the Website will be in accordance with the Terms and Conditions.

If you do not agree to the Terms and Conditions, you may not access or use the Services or the Website.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this contract or its subject matter or formation (including non-contractual disputes or claims)

The Terms and Conditions together with any additional terms and conditions specific to a particular auction constitute the entire agreement (the "Agreement") between Redpoint and User  and replace any earlier version of the Terms and Conditions.

Redpoint may amend  the Terms and Conditions at any time, at Redpoint's sole discretion, without notice. Any amendment of the Terms and Conditions will be displayed on the Website.  Use of the Services and the Website constitutes an acceptance of the current Terms and Conditions.

Role of Redpoint.

Redpoint provides the Services and the Website only as a service for auctioneers ("Sellers") who offer for sale items and Bidders may may bid these items. Redpoint is neither a principal with interest in the transactions, nor an agent of Bidder or Seller. Redpoint does not make, and should not be construed as having made, any representation or warranty of any kind concerning any of the offered assets or offerings, including without limitation any representation or warranty regarding the quality, safety or legality of the offered assets, or the truth or accuracy of any offerings.

Redpoint makes no representation or warranty of any kind as to the ability of either Bidder or Seller to complete a sale in accordance with these Terms and Conditions or otherwise, and in accordance with any additional terms and conditions specific to a particular auction.

Redpoint does not have the power to transfer title of any assets offered by Sellers.

Redpoint may at its sole discretion to block any User who does not comply with the Terms and Conditions.

In the event of any dispute regarding any transaction conducted through use of the Services or the Website the User hereby releases Redpoint, its partners and subsidiaries, and their respective directors, employees, agents and successors in title and each of the foregoing, from any and all manner of action or claim  and from any and all losses, damages, costs or expenses, including without limitation court costs and legal fees, which User may have against the Released Parties.

In particular, Redpoint shall not be held responsible for any loss, damage or cost or expense arising from the use of the Service, or in Redpoints' failure to provide The Service. The Service is not guaranteed to be error free or to be available at any time.

Auktionshaus AGB
The auction is conducted on behalf and for the account of the owner of the goods according to Austrian Trade Regulation Acts. Any Person
participating or registering for the Auction agrees to be bound by and accepts these Terms and Conditions of Auction
Description: The descriptions and the grading of the material represented in the catalogue have been executed with great care. The
illustrations are part of the description and in case of doubt the text is authoritative. The grading of coins is a personal judgement but
corresponds to the accepted grading scale in the European coin business.
Auction procedures: The auction sale is conducted in Euros (€). The prices in the catalogue are minimum prices and bids below these prices
cannot be accepted. The highest qualified bidder recognized by the auctioneer shall be the buyer; he cannot claim to have acted on behalf of
a third party. We can only accept orders from collectors not known to us if the identity of the person can be established. Due to the Data
Protection Act now in force we ask to send us a copy of the identity card or passport together with satisfactory card information. Another
possibility is to lodge a deposit. New clients have to register at least two business days before the auction.
Absentee bids can be sent to us by post, fax, e-mail or by using the facilities of the online catalogue. The bids must be received by us at least
by 7 a.m. MEC on the day of the auction. We do not accept any liability for bids which we may receive during the auction. Bids received in
the last two days before the auction cannot be confirmed in writing. To optimize the chance of winning, absentee bidders can give either/or
bids or limit the total bidding sum (exclusive the commission). H.D. Rauch GmbH cannot be made responsible for errors in bidding, so carefully
check that every bid is entered correctly. Oral bids should be confirmed in writing (fax or e-mail) to avoid mistakes.
Telephone bidding: for real-time telephone bidding during the auction the client has to make preliminary arrangements with the Auction House
at least one business day before the auction starts. Telephone bidding is accepted exclusively on lots with a starting price of more than € 100,-
-. The bidder has to give us the lot numbers for which he wants to bid by phone and a valid telephone number. We take it for granted that the
telephone bidder bids at least the starting price on these lots. We are not liable for failure to execute such bids if telephone bidding gets
interrupted or cannot be achieved.
Floor bidding: Any client needs to take a bidding card or paddle on the floor before going in the auction room. Viewing can be done before
and during the auction without problems. A floor bidder may request the auctioneer to accept a bid at half of the increment (“cut bid”) only
once per lot. As soon as the client closes his biddings he can ask for the invoice and the coins. The invoice can be paid in cash (if the sum is
more then € 5.000 we have to ask according to law for a personal document). Byers who attend the auction buy “as seen” as each lot is
available for examination before the sale; except for reasons of hidden repairs on the coin, mounting or authenticity lots cannot be claimed.
The bidding increments as a general rule are 5 to 10 %. Bids that do not conform to a full increment will be rounded up to a full
increment and this revised amount will be considered your high bid. In case of identical bids, the earliest incoming bid wins. No „buy“ or
„unlimited“ bids will be accepted Hammer price: The hammer price will be executed at one bidding increment over the next highest bid. All
auction sales are final. A written bid has priority over an identical floor bid. The auctioneer reserves the right to combine or to separate lots; to
withdraw lots or reoffer the lot for bidding again in case of error or dispute.
Invoice: The hammer price represents the basis for the buyer’s premium of 18,5 % and VAT (Value Added Tax). A letter in front of the lot
number marks for the purchaser the applicable VAT rate. All shipping charges will be borne by the successful bidder.
B = zero rated coins. Gold coins issued after 1800 and which were or still are legal tender and investment gold coins are exempted from
VAT if granted by the European commission. The customer pays 18,5 % premium.
D = Auctioneer’s Margin Scheme is 22 % are added on the hammer price. VAT and the buyer’s premium are included.
Buyers resident outside the EEC pay a buyer’s premium of 20 % and no VAT if the goods are delivered by us. If the Buyer wants to export the
lots by himself we will be furnished by us with the export papers of Logsped according to his instructions at his own expense. Purchasers from
abroad will have to observe all applicable laws and regulations in respect of custom duties and taxation in their country.
Payment period: Title to any goods shall only pass to the purchaser upon payment in full. Unless mutually agreed otherwise, payment of the
auction bill is due immediately if the buyer is present on the floor; this is also valid for bidders who have acted on behalf of another client.
From purchasers who have submitted written bids, bidden by phone or live, payment is due within 10 days after receipt of the goods. We are
entitled to ask payment in advance of all clients. Rauch GmbH reserves the right to resell the material of an auction for which a bidder has
not paid and the bidder is obliged to pay for the reasonable costs of such a sale and also pay any difference between the resale price and
the previously successful bid.
The payment can also be done by credit card (VISA and MASTER) or PayPal if the client adds a surcharge of 4,5 % to the total sum of the
invoice for the handling. US Dollar cheques drawn to an US bank are accepted, not cheques in Euro unless the clients includes into the sum
of the invoice the high bank costs. After the period of 30 days has expired 1 % interests are charged per month.
Shipment: All shipping charges will be borne by the buyer of the auction goods. Instructions for shipping must be given right after the auction.
We ship the goods according to postal regulations or by FEDEX. The minimum costs are: Domestic: € 15,--; Europe: € 20,--; overseas: € 30,-
-. Any shipment is insured. Insurance regulations require that losses or damages in shipment have to be reported immediately and confirmed
by evidence (photo, damaged envelops) The buyer or recipient is liable for the costs of shipment which are returned by post because of the
carelessness of the buyer or recipient. If the client does not receive the shipment in time (visit myHDRauch) he has to give notice; postal
investigations are warrented only 3 months
Complaints and authenticity. First of all please be aware that an auction sale is not an approval sale. All coins in this sale are guaranteed
genuine and as described. There is no limit of time to claim the genuineness of coins sold in our auctions. The authenticity of the coins and
medals is warranted up to the total purchase price. All other claims which are due to an error in description (like plugging of a hole, traces of
mounting etc.) must be made within 20 days after receiving the auction material. If bidders who have to pay in advance fail to settle the sum
due within 20 days the time for claims because of errors in description has run out. Coins and medals graded as fine or less as well as multiple
lots are excluded from warranty. Lots also cannot be claimed. Claims are handled on behalf of the owner or seller i.e. the person or company
who instructed the auctioneer to offer the material for sale. We reserve for us the right to ask the buyer to turn directly to the owner with his
claim. This will always be the case when the account with the seller has been settled. Return payments for shipment which got lost will be
settled as soon as the postal investigation has confirmed the loss.
Handling with Grading Companies. Coins that have been encapsulated (“slabbed”) by a Grading Companies such may not be returned for
any reason, including authenticity. Complaints based on a different quality assessment by Grading-Companies do not entitle the Buyer to
cancel his purchase transaction.
Any and all disputes should be subjected to the exclusive jurisdiction of Vienna courts, except for those to recover payment for lots sold
hereunder which may be pursued wherever the buyers may be found.

VERSTEIGERUNGSBEDINGUNGEN

Das Auktionshaus H.D. Rauch GmbH führt als Kommissionär die Versteigerung im eignen Namen und für Rechnung der
Einlieferer, die unbenannt bleiben, durch unter Einhaltung der Bestimmungen der österreichischen Gewerbeordnung. Mit
Abgabe eines schriftlichen oder telefonischen Gebotes erkennt der Kaufinteressent die Auktionsbedingungen im vollen Umfang
an.
Die Beschreibung der Lose im Katalog sowie die Erhaltungseinstufungen wurden mit äußerster Sorgfalt vorgenommen. Die
Abbildung der Stücke im Katalog und online sind Bestandteil der Beschreibung; im Zweifelsfall hat der Text Priorität. Eventuelle
Beschreibungsfehler begründen keine Rechts‐ und Sachmängelhaftung. Die Angaben der Erhaltungseinstufungen wurden streng
nach den im europäischen Münzhandel üblichen Erhaltungsstufen vorgenommen und gelten als persönliche Beurteilung
Schriftliche Auktionsteilname: Die im Katalog angegebenen Ausrufpreise in Euro (€)sind Mindestpreise, die nicht unterschritten
werden können. Schriftliche (Auktionsauftrag, e‐mail, Fax etc.) oder telefonische Gebote können bis 7 Uhr Früh (MEZ) am
Auktionstag abgegeben werden. Die Anmeldung neuer Kunden für die Auktion muss mindestens 2 Arbeitstage vor dem
Auktionstermin erfolgen. Aufgrund des neuen Datenschutzgesetzes ist eine Referenzüberprüfung nicht mehr möglich. Ein
Identitätsnachweis ist daher durch Übersendung eine Kopie des Personalausweises und einer gültigen Kreditkarte (VISA,
MASTER)) zu erbringen. Möglich ist auch die Errichtung eines Depots von 25 r Gebotssumme als Vorauszahlung. Der Betrag
wird an mit dem Kauf verrechnet bzw. die eingezahlte Summe zurücküberwiesen. Unser Auktionshausist bemüht, jeden Auftrag
sowie eventuelle Sonderwünsche bezüglich Oder‐Gebote, Limitierung der Kaufsumme usw. gewissenhaft auszuführen, kann
aber keine Gewähr übernehmen. Irrtümer bei der Gebotsabgabe gehen zu Lasten des Bieters. Die Steigerungsstufen betragen
in der Regel 5‐ 10 % (siehe Tabelle). Bei mehreren gleich hohen schriftlichen Aufträgen erhält das zuerst eingetroffene Gebot
den Zuschlag. Unlimitierte Gebote, wie „Kauf“ oder „Best“ können nicht angenommen werden.
Telefonisches Live‐Bieten muss 24 Stunden vor dem Auktionstag abgesprochen werden. Telefonischen Vorgebote bedürfen
einer schriftlichen Bestätigung (Fax oder e‐mail), um Hörfehler zu vermeiden. Die vom Kunden gewünschten Losnummern und
eine zu diesem Zeitpunkt gültige Telefonnummer müssen mindestens 24 Stunden vor dem Auktionsbeginn bekannt gegeben
und die gewünschte Losnummer mindestens zum Rufpreis beboten werden. Telefonisches Live‐Bieten ist nur bei Losen über €
100 Rufpreis möglich. Sollte eine telefonische Verbindung nicht rechtzeitig zustande kommen, so kann das Auktionshaus dafür
nicht verantwortlich gemacht werden.
Saalbieter: Jeder Kunde muss vor Betreten des Auktionssaales eine Bieternummer nehmen und sich registrieren. Wir sind nach
dem Geldwäschegesetz (GWG) verpflichtet, alle Bieter zu Identifizieren. Als Bieter verpflichten Sie sich alle notwendigen
Identifizierungsunterlagen (Kopie des Ausweises, Handelsregisterauszug, etc.) auf Nachfrage uns zu übermitteln.
Der Saalbieter kauft wie besehen, kann jederzeit abrechnen und die Objekte mitnehmen. Bei Beträgen über
€ 5.000,‐ muss sich der Kunde laut Gesetz mit einem gültigen Personaldokument ausweisen. Die Auktionsware kann während
der ganzen Auktion besichtigt werden, daher sind Einwendungen kein Reklamationsgrund.
Zuschlagspreise: Der Zuschlag erfolgt nach dreimaligem Ausruf des höchsten Gebotes und verpflichtet zur Abnahme und
Zahlung. Der Zuschlagspreis liegt eine Steigerungsstufe über dem vorletzten Gebot. Wenn der Auktionator nichts anderes
bestimmt, werden die Lose in der Nummernfolge des Kataloges angeboten. Der Auktionator hat das Recht, Gebote nicht
anzunehmen, Lose zu trennen, zurückzuziehen oder zusammenzuziehen. Bei Missverständnissen während der Auktion ist der
Auktionator berechtigt, die Steigerung neu zu eröffnen. Im Falle eines Irrtums im Katalog gibt der Auktionator die Korrektur
bekannt und verkauft das Los gemäß dieser Änderung, wobei schriftliche Gebote nicht berücksichtig werden können, außer der
schriftliche Bieter hat uns bei Abgabe des Gebotes darauf aufmerksam gemacht, dass er den Irrtum bemerkt hat. Im Saal und
bei online live‐bieten besteht die Möglichkeit nur die halbe Steigerungsstufe zu bieten. Dies kann aber pro Los nur einmal
gemacht werden.
Preisgestaltung: Der Zuschlagspreis ist ein Nettopreis im Sinne des Umsatzsteuergesetzes und bildet die Berechnungsgrundlage
für das vom Käufer zu zahlende Aufgeld.
B = Umsatzsteuerbefreite Münzen (laut EU‐Liste „Befreites Anlagegold“). Der Käufer zahlt auf das Meistbot 18,5 % Aufgeld
D = Differenzbesteuerte Objekte: Der Käufer zahlt auf das Meistgebot 22% Aufgeld. In dieser Summ ist die gesetzliche
Mehrwertsteuer enthalten. Käufer aus Drittländern zahlen für alle bei der Auktion gekauften Objekte ein Aufgeld von 20 % auf
den Zuschlagspreis plus Versandkosten, sofern die erworbene Ware von uns exportiert wird.
Zahlungsfrist: Sofern nichts anderes vereinbart wird, ist die Bezahlung der Auktionsrechnung sofort, bei schriftlichen Bietern
spätestens 10 Tage nach Erhalt der Ware fällig. Bei Zahlungsverzug werden Zinsen von 1 % pro Monat verrechnet. Das
Eigentumsrecht geht erst nach voller Bezahlung der Ware an den Käufer über. Wir behalten uns das Recht vor, die Auktionsware
zurückzubehalten und erst nach voller Bezahlung auszuliefern. Rechtsmittelkosten und andere im Zusammenhang mit dem
Inkasso entstehenden Kosten gehen zu Lasten des Käufers. Bei Bezahlung mit Kreditkarte oder Paypal werden die vom
Kreditinstitut uns verrechneten Spesen in Höhe von 4,5 r Rechnungssumme dem Kunden weiterverrechnet. Kunden aus
der Schweiz und Großbritannien zahlen bei Überweisung nach Österreich erhöhte Bankspesen. Bei Vorauskassen, die trotz
Mahnungen nicht bezahlt werden, verliert der Käufer seine Rechte aus dem Zuschlag und die Auktionsware kann auf seine
Kosten dann wieder versteigert werden. In diesem Fall haftet der Käufer für den Ausfall des uns zustehenden Betrages, der auch
gerichtlich eingeklagt werden kann. Auf den Mehrerlös hat der Käufer aber keinen Anspruch.
Versand: Er erfolgt auf Kosten und Risiko des Käufers. Für Porto und Versicherung werden mindestens in Rechnung gestellt:
Inland € 15,‐; Europa 20,‐ und für außereuropäische Länder € 30,‐. Kunden aus Drittstaaten kaufen nach den rechtlichen
Bestimmungen

ihres Landes. Versandformalitäten werden vom Auktionshaus erledigt. Kommt die Sendung beschädigt an oder der Kunde erhält
innerhalb eines Monats keine Sendung oder Verständigungsbrief (alle Rechnungen können unter myHDRauch auf unserer
website abgefragt werden), dann muss uns der Kunde unverzüglich benachrichtigen, damit wir die Versicherung verständigen
und eine postalische Nachforschung einleiten können. Bekommen wir die Information des Kunden zu spät, hat er keinen
Anspruch auf Ersatz.
Reklamationen: Alle Objekte werden grundsätzlich als echt und gemäß der Beschreibung verkauft. Alle anwesenden Bieter
kaufen grundsätzlich „wie besehen“; sie können keine Beanstandung betreffend Qualität und Beschreibung nach erfolgtem
Zuschlag geltend machen. Ausgenommen sind verdeckte Mängel. Bei persönlicher Übernahme der Ware müssen eventuelle
Reklamationen bezüglich Qualität und fehlerhafter Beschreibung sofort vorgebracht werden. Berechtigte Reklamationen
werden selbstverständlich anerkannt, nur müssen die reklamierten Stück in dem von uns gelieferten Zustand sein. Generell von
der Qualitätsgewährleistung sind ausgeschlossen Lots (die angegeben Stückzahl ‐ wenn sie nicht wesentlich abweicht – ist nur
als Zirka‐ Angabe zu verstehen) und Münzen und Medaillen mit der Qualitätsbezeichnung „schön“ oder „sehr gut erhalten“
(s.g.e.). Ausgenommen von der Reklamationsfrist ist die Echtheit der Stücke für die wir bis zur Höhe des Kaufpreises immer
garantieren. Bei Meinungsverschiedenheiten kann der Versteigerer Sachverständige seiner Wahl beiziehen; die Kosten trägt der
Unterlegene.
Umgang mit Grading‐Unternehmen wie PCGS, NGC etc.. Münzen, die von einer Bewertungsfirmen verkapseltsind, können nicht
reklamiert werden; wir bürgen auch nicht für deren Echtheit. Käufer, die die bei uns ersteigerten Münzen und Medaillen zu
Grading‐Firmen senden und es dann zu einer abweichenden Qualitätsbewertung kommt, berechtigt den Käufer nicht eine
Rückabwicklung seines Kaufes zu verlangen..
Bei Kunden, die auf Vorauskasse kaufen, können Reklamationen nur bis 20 Tage nach der Auktion entgegengenommen werden.
Reklamationen werden von uns grundsätzlich für Rechnung der Einlieferer erledig. Es bleibt uns vorbehalten, die Bieter, soweit
Ansprüche gegeben sind, darauf zu verweisen, diese direkt gegen den Einlieferer geltend zu machen. Davon wird immer dann
Gebrauch gemacht, wenn mit dem Einlieferer bereits abgerechnet wurde.
Gerichtsstand: Es gilt ausschließlich österreichisches Recht. Das Übereinkommen der Vereinten Nationen über Verträge über
den internationalen Warenverkauf (CSIG) findet keine Anwendung. Als Gerichtsstand für alle sich mittelbar aus einer Auktion
ergebenden Streitigkeiten ist ausschließlich das örtliche und sachlich zuständige österreichische Gericht in Wien zuständig.
Soweit die Versteigerungsbedingungen in mehreren Sprachen vorliegen, ist stets die deutsche Fassung maßgebend.
