The services provided by Redpoint Consulting Limited ("Redpoint") through the Website ("Service" or "Services") and the use of the Website are governed by these Terms and Conditions ("Terms and Conditions"). By accessing or using the Services or the Website or by registering as a bidder ("Bidder" or "User"), you agree that
- You have read the Terms and Conditions,
- You understand the Terms and Conditions, and
- Your use of the Services and the Website will be in accordance with the Terms and Conditions.
If you do not agree to the Terms and Conditions, you may not access or use the Services or the Website.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this contract or its subject matter or formation (including non-contractual disputes or claims)
The Terms and Conditions together with any additional terms and conditions specific to a particular auction constitute the entire agreement (the "Agreement") between Redpoint and User and replace any earlier version of the Terms and Conditions.
Redpoint may amend the Terms and Conditions at any time, at Redpoint's sole discretion, without notice. Any amendment of the Terms and Conditions will be displayed on the Website. Use of the Services and the Website constitutes an acceptance of the current Terms and Conditions.
Role of Redpoint.
Redpoint provides the Services and the Website only as a service for auctioneers ("Sellers") who offer for sale items and Bidders may may bid these items. Redpoint is neither a principal with interest in the transactions, nor an agent of Bidder or Seller. Redpoint does not make, and should not be construed as having made, any representation or warranty of any kind concerning any of the offered assets or offerings, including without limitation any representation or warranty regarding the quality, safety or legality of the offered assets, or the truth or accuracy of any offerings.
Redpoint makes no representation or warranty of any kind as to the ability of either Bidder or Seller to complete a sale in accordance with these Terms and Conditions or otherwise, and in accordance with any additional terms and conditions specific to a particular auction.
Redpoint does not have the power to transfer title of any assets offered by Sellers.
Redpoint may at its sole discretion to block any User who does not comply with the Terms and Conditions.
In the event of any dispute regarding any transaction conducted through use of the Services or the Website the User hereby releases Redpoint, its partners and subsidiaries, and their respective directors, employees, agents and successors in title and each of the foregoing, from any and all manner of action or claim and from any and all losses, damages, costs or expenses, including without limitation court costs and legal fees, which User may have against the Released Parties.
In particular, Redpoint shall not be held responsible for any loss, damage or cost or expense arising from the use of the Service, or in Redpoints' failure to provide The Service. The Service is not guaranteed to be error free or to be available at any time.

Versteigerungsbedingungen
Mit der Abgabe von mündlichen oder schriftlichen Geboten zu dieser Auktion werden die nachstehenden Bedingungen uneingeschränkt anerkannt. Abweichungen hiervon bedürfen der beiderseitigen schriftlichen Anerkennung.
1. Die Versteigerung erfolgt im Auftrag und für Rechnung der Eigentümer unter Einhaltung der sich aus der Versteigerungsverordnung ergebenden und für Kommissionäre geltenden gesetzlichen Bestimmungen des BGB und HGB gegen Barzahlung des Kaufpreises in Euro-Währung. Die Zahlung ist ausschließlich an den Versteigerer zu leisten.
2. Der Zuschlagspreis bildet die Berechnungsgrundlage für das vom Käufer zu zahlende Aufgeld. Für Käufer aus EU-Ländern gilt: Für Verbraucher wird einheitlich ein Aufgeld von 23 % + 2 % Gebühr bei live mitbieten im Internet und telefonischem Bieten (im Gesamtbetrag ist die gesetzliche Umsatzsteuer enthalten) erhoben. Für ein Zustandekommen einer Telefonleitung kann nicht garantiert werden. Für Unternehmer i.S.d. UStG wird bei differenzbesteuerter Ware ein Aufgeld von 23 % + 2 % Gebühr bei live mitbieten im Internet erhoben (im Gesamtbetrag ist die gesetzliche Umsatzsteuer bereits enthalten), bei regelbesteuerter Ware ein Aufgeld von 20 % + 2 % Gebühr bei live mitbieten im Internet (zzgl. gesetzlicher Umsatzsteuer auf Gesamtbetrag von Zuschlag und Aufgeld).
Für Käufer mit Wohnsitz in Drittländern (außerhalb der EU) gilt: Das Aufgeld beträgt einheitlich 20%. Wird die Ware vom Käufer selbst oder durch Dritte in Drittländer ausgeführt, wird die gesetzliche Umsatzsteuer berechnet, jedoch bei Vorlage der gesetzlich geforderten Ausfuhrnachweise erstattet. Führen wir diese Ware selbst in Drittländer aus, wird die gesetzliche Umsatzsteuer nicht berechnet.
Für Goldmünzen, die von der gesetzlichen Umsatzsteuer befreit sind, wird ein Aufgeld von 20 ?rechnet.
3. Ausländische Kunden werden gebeten, die Devisen- und Einfuhrbestimmungen ihres Staates zu beachten. Der Versteigerer lehnt die Verantwortung für alle Folgen ab, die sich aus Zuwiderhandlungen gegen derartige Bestimmungen ergeben können.
4. Die im Katalog ausgedruckten Schätzpreise sind gleichzeitig die Ausrufpreise, die nicht unterschritten werden können. Schriftliche Aufträge, die dies nicht berücksichtigen, können nicht bearbeitet werden.
5. Schriftliche Aufträge werden von uns ohne eine zusätzliche Auftragsprovision interessewahrend ausgeführt. Bei mehreren gleich hohen schriftlichen Geboten können wir nach freiem Ermessen einem Bieter den Zuschlag erteilen. Wir sind nötigenfalls berechtigt, die Gebote um 3-5% zu überschreiten. Die Steigerungsstufen betragen jeweils 5 bis 10% vom aktuellen Gebot. Für schriftliche Bieter gelten folgende Steigerungsraten:
Bis 50 € - 2,00 € bis 100 € - 5,00 € bis 200 € - 10,00 € Bis 500 € - 20,00 € bis 1000 € - 50,00 € bis 2000 € - 100,00 € Bis 5000 € - 200,00 € bis 10000 € - 500,00 € Über 10000 € - 5-10% vom jeweiligen Gebot.
Der Auktionator ist berechtigt, Gebote, die diese Steigerungsraten nicht berücksichtigen, auf die nächsthöhere Möglichkeit zu erhöhen.
Beispiel: Bei einem gebotenen Betrag von 301,00 €, wird der Betrag 320,00 € eingesetzt.
Wir berücksichtigen bestmöglich schriftliche oder fernmündliche Gebote bzw. Gebote übers Internet und behandeln diese grundsätzlich gleich. Aufträge von uns unbekannten Sammlern können wir nur ausführen, wenn ein Depot hinterlegt wird oder Referenzen benannt werden. Schriftliche Gebote können nur bis 24 Stunden vor Auktionsbeginn berücksichtigt werden, telefonische Bieter müssen sich mindestens 2 Werktage vor der Auktion voranmelden. Unlimitierte Aufträge haben keinen Anspruch auf unbedingte Ausführung. Schriftliche, fernmündliche und schriftliche Internet-Gebote werden von uns ohne Auftragsprovision ausgeführt; sie müssen den Gegenstand mit Katalognummer und des gebotenen Preises, der sich als Zuschlagssumme ohne Aufgeld und Umsatzsteuer versteht, benennen und sind bindend. Unklarheiten oder Ungenauigkeiten gehen zu Lasten des Bieters. Wir übernehmen für diese Gebote jedoch keinerlei Haftung, insbesondere nicht für das Zustandekommen und die Aufrechterhaltung von Telekommunikationsverbindungen oder/und Übermittlungsfehlern, ebenso wenig für Ausfall- und Verzögerungszeiten, verursacht durch Wartungen und Wiederherstellungen des jeweiligen Servers, durch Störungen und Probleme im Internetverkehr, durch höhere Gewalt, sowie weitere Störungen, die durch Umstände begründet sind, die außerhalb unserer Verantwortung liegen. Dies gilt nicht für den Fall, dass uns hieran der Vorwurf grober Fahrlässigkeit oder Vorsatz trifft.
6. Der Zuschlag erfolgt nach dreimaligem Ausruf des höchsten Gebotes und verpflichtet den Bieter zur Abnahme. Bei Meinungsverschiedenheiten über die Wirksamkeit des Gebotes wird das betreffende Los nochmals ausgerufen.
7. Der Auktionator kann den Zuschlag unter Vorbehalt erteilen, Nummern ausfallen lassen oder deren Reihenfolge bzw. deren Zusammenstellung ändern.
8. Jeder Teilnehmer an der Auktion ist für die von ihm getätigten Käufe persönlich verantwortlich. Er kann nicht geltend machen, für Rechnung Dritter gekauft zu haben.
9. Der Versand geht zu Lasten und auf Risiko des Ersteigerers bzw. Empfängers. Das Eigentum geht erst nach Zahlung des vollen Rechnungsbetrages an den Käufer über. Bei Annahmeverweigerung oder Zahlungsverzug ist der Versteigerer berechtigt, auf Kosten des Ersteigerers die Ware erneut zu versteigern. In diesem Falle haftet dieser für einen evtl. Mindererlös, während er auf einen Mehrerlös keinen Anspruch hat.
10. Der Rechnungsbetrag ist mit Zustellung der Auktionsrechnung fällig. Beträge, die 14 Tage nach Erhalt der Rechnung nicht bei uns eingegangen sind, erhöhen sich um einen Verzugszuschlag von 2 % und um Verzugszinsen von 1 % pro angefangenen Monat.
11. Es werden nur Gebote in Euro berücksichtigt.
12. Wir garantieren für die Echtheit aller zur Versteigerung kommenden Stücke entsprechend der Beschreibung.
13. Die Katalogbeschreibungen sind keine vertraglich vereinbarten Beschaffenheiten i.S.d. § 434 BGB, sondern dienen lediglich zur Information und zur Abgrenzung der Ware. Die Angebe der Erhaltung ist streng nach den im deutschen Münzhandel üblichen Erhaltungseinstufungen vorgenommen und eine persönliche Beurteilung. Die Echtheit der Stücke wird gewährleistet, sofern nichts Gegenteiliges im Katalog oder bei der Versteigerung angegeben wird; hier haften wir für einen insoweit entstandenen Schaden bis zur Höhe des Kaufpreises. Im Übrigen übernehmen wir keine Rechts- oder Sachmängel bezüglich der im Katalog aufgeführten Ware.
Wir geben durch Vorbesichtigung Gelegenheit, sich vom Erhaltungszustand der Ware zu überzeugen. Fehler, die sich bereits aus den Abbildungen ergeben, berechtigen nicht zur Beanstandung. Bei der Auktion anwesende Käufer kaufen grundsätzlich „wie besehen“. Bei Losen mit mehreren Stücken sind die Stückzahlen nur ca.-Angaben. Gewährleistungsansprüche wegen Sach- und Rechtsmängeln oder irrtümlichen Zuschreibungen sind ausgeschlossen. Innerhalb der gesetzlichen Gewährleistungsfrist vorgetragene und begründete Mängelrügen des Käufers leiten wir jedoch unverzüglich an den Einlieferer der bemängelten Sache weiter. Nach unserer Wahl treten wir unsere gegen den Einlieferer aus der Verletzung des Kommissionsvertrages zustehenden Ansprüche an den Käufer ab bzw. stellen den Käufer durch Rückabwicklung des Kaufvertrages schadlos, wobei ein über die Erstattung des Kaufpreises hinausgehender Anspruch des Käufers ausgeschlossen ist.
Wenn Sie die von uns erworbene Ware einem Grading Service übergeben wollen, übernehmen wir keine Garantie, dass die Münzen dort angenommen oder entsprechend unserer Bewertung eingestuft werden.
Schadenersatzansprüche des Käufers gegen uns sind – gleich aus welchem Rechtsgrund – ausgeschlossen. Dies gilt nicht für Schäden, die auf einem vorsätzlichen oder grob fahrlässigen Verhalten von uns, unseren gesetzlichen Vertretern oder Erfüllungsgehilfen beruhen bzw. ihre Ursache in der Verletzung von vertraglichen Kardinalpflichten haben; im letzteren Fall ist Haftung jedoch auf den vorhersehbaren, vertragstypischen Schaden beschränkt. Die Haftung aus Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit bleibt unberührt.
Der Käufer kann nicht aufrechnen, es sei denn, seine Gegenansprüche sind rechtskräftig festgestellt, unbestritten oder von uns anerkannt. Zurückbehaltungsrechte des Käufers sind ebenfalls ausgeschlossen, es sei denn, er ist nicht Unternehmer i.S.d. § 14 BGB und sein Gegenanspruch beruht auf demselben Vertragsverhältnis.
14. Ansichtssendungen können gegen Portoersatz nur an uns bekannte Kunden vorgenommen werden.
15. Es bleibt dem Auktionator vorbehalten, Personen aus besonderen Gründen von der Auktion auszuschließen.
16. Es gilt ausschließlich das Recht der Bundesrepublik Deutschland. Das Übereinkommen der Vereinten Nationen über Verträge über den internationalen Warenkauf (CISG) findet keine Anwendung. Gegenüber Unternehmern i.S.d. § 14 BGB und Käufern ohne allgemeinen Gerichtsstand im Inland ist Erfüllungsort und ausschließlicher Gerichtsstand bei allen aus dem Vertragsverhältnis unmittelbar oder mittelbar sich ergebende Streitigkeiten Kassel. Sollte eine der Bestimmungen ganz oder teilweise unwirksam sein oder werden, bleibt die Gültigkeit der übrigen davon unberührt. Die unwirksame ist durch eine wirksame zu ersetzen, die dem wirtschaftlichen Gehalt und Zweck der unwirksamen Bestimmung am nächsten kommt. Gleiches gilt für eine Lücke. Soweit die Versteigerungsbedingungen in mehreren Sprachen vorliegen, ist stets die deutsche Fassung maßgebend.

Auction Terms
The following terms are accepted unconditionally by the making of verbal or written bids during this auction. Deviations require the written acceptance of both sides.
1. The auction is conducted on behalf and for account of the appropriate proprietors of the goods.
2. The hammer price is the basis for the calculation of the buyer´s surcharge. As far as goods are delivered by standard taxation, the standard taxation will apply according to the legal requirements. For these goods the buy price is hammer price plus 20 % surcharge + 2 % charges by Live bidding on the Internet and telephone bidding. The establishment of a telephone connection cannot be guaranteed. On the entire amount the relevant VAT is added. For goods delivered by difference taxation the buy price is hammer price plus 23 % surcharge + 2 % charges by Live bidding on the Internet and telephone bidding (relevant VAT included). In case buyers from abroad (no EEC country) export the goods by themselves or third parties, the relevant VAT will be charged but refunded by presentation of the legally export certificate. In case we export these goods the relevant VAT will not be charged.
3. Foreign customers should consider the currency and import regulations of their country. The auctioneer refuses to accept the responsibility for all the consequences, which could be the result of an offence against one of these conditions.
4. No bids will be considered below the printed estimates stated in the catalog. The estimates will be the opening bids.
5. The hammer shall fall after the highest bid has been called out three times. The knockdown shall oblige to take immediately delivery of the goods. Upon good cause shown we can refuse or reserve the knock down. In the event of several equal bids we have the right to knock down at our own discretion, to decide by drawing lots or re-open the bidding. The auctioneer reserves the right to combine or to separate lots for good cause. Lots will not be called out of sequence. In case of a reserved knock down the bid expires 4 weeks after the knock down unless we informed the bidder within this period of the unreserved acceptance. Ownership of the goods shall not pass until full payment. Bidding rates are 5-10% of actual bid. For orders submitted in writing, the minimum rates of increase for bidding procedure are:
Up to 50 € - 2,00 € up to 100 € - 5,00 € up to 200 € - 10,00 € Up to 500 € - 20,00 € up to 1000 € - 50,00 € up to 2000 € - 100,00 € Up to 5000 € - 200,00 € up to 10000 € - 500,00 € over 10000 € - 5-10% of actual bid
The auctioneer has the right to change bids, not considering this to the next higher possible bid, i.e. bid of 301,00 € changes to 320,00 € We carry out best possible written or orders via telephone or internet. Orders from collectors unknown to the auctioneer can only be accepted and carried out if a deposit or references to the satisfaction on the auctioneer are given. To be bindingly accepted, written bids need to be received at least 24 hours before auction, bids via telephone need to be registered at the latest 2 workdays before auction. If necessary, we are allowed to increase the bids by 3-5%. Unlimited bids shall not oblige us to consider, accept or carry out such order. Written orders or those via telephone or Internet will be carried out without charge of an extra commission; they shall name the item with catalog number and the bid price and are binding. Ambiguities shall be carried by the bidder. We do not assume any liability for such bids, especially not for connecting and keeping up telephone lines and/or transmission errors, as well as not for off times and lag times, caused by attendance and restore of the server, by errors and problems of the Internet, by force majeure or reason outside of our responsibility. This does not apply in case we are acting in international or grossly negligence. New customers wanting to bid live in the auction have to register at least three working days before starting the sale, quoting checkable references or placing a deposit (about 40 % of bids). Only after fulfilment of this we can unlock you for live bidding.
6. The knock down follows after three calls of the highest bid and obliges the high bidder to buy. Disagreements between active bidders will be settled in the discretion of the auctioneer by repeating the call of the lot in question.
7. The auctioneer, at his sole discretion, may withdraw lots from the auction, may make changes as to the printed catalog information prior to the coins being offered and he may change the sequence in which lots are offered.
8. Every participant at the auction is personally responsible for all purchases made by him. He cannot assert, to have bought for others. Unknown customers are requested to legitimize themselves before the auction. Bids of unknown customers can only be accepted and carried on if a deposit or reference to the satisfaction of the auctioneer are given.
9. Shipment of the goods shall be for the sole cost and risk of the purchaser or recipient. The customer only receives the property after the payment of the total invoice. Nonacceptance or default or payment permits the auctioneer to auction off the article again, at the expense of the customer. In this case, the person could be held responsible for costs, that may result, although he is not entitled to any profits, that might develop.
10. Winning bids are due upon the receipt of the auction invoice. Sums not received within 14 days of the arrival of the invoice are considered late and will be subject to a penalty of 2% and a late charge of 1% interest for each month or portion thereof the payment is late.
11. Only bids in Euro will be considered.
12. We guarantee the genuineness of the objects to be auctioned off.
13. The descriptions of the goods in the catalog do not constitute any warranty or liability in the meaning of § 434 BGB but are provided as mere information. The state of preservation of items is strictly assessed in accordance with the grades accepted by the German coin trade and only represents an individual and personal assessment. The authenticity of the coins is warranted (up to the total purchase price) unless anything to the contrary is noted in the catalog or the auction. In other respects, any and all warranty claims based on material defects of quality and defects of title are excluded. In view of the opportunity of prior inspection to ascertain the state and condition of the auction lots, complaints of errors resulting of the images are excluded. Buyers present at the auction acquire items strictly on the basis of “as is where is” and “as inspected”. For lots with several pieces, the numbers of pieces are only approximate. Any and all warranty claims based on material defects of quality and defects of title or on an error in the allocation of individual pieces to a certain lot are excluded. We forward quality complaints to the deliverer claimed within the legal period of warranty. To our own choice we assign possible claims resulting out of the commission contract to buyer or compensate buyer by unwinding of contract, at which a claim of buyer exceeding the purchase price is excluded. In case buyer intends to deliver goods to a Grading Service, we do not guarantee the respective acceptance or the classifying to our valuation. Damage claims of buyer – irrespective of legal basis – are excluded. This shall not apply for damages resulting out of our intentional or grossly negligent conduct of our legal representatives respectively are caused in the breach of contractual cardinal obligations; to this degree, liability is limited to damages that ate foreseeable and typical for this type of contract. This shall not effect our liability for damages to life, limb or health. Offsetting counterclaims of buyer are excluded, unless the claim is contested or has been declared legally valid by court. Retentions rights of buyer are excluded unless he is not a trader (§ 14 BGB) and his counterclaim results from the same contractual relationship.
14. Only customers familiar to us may receive lots prior to the auction for inspection on an approval basis. The customer will bear any costs incurred in the event coins are sent out on approval.
15. The auctioneer may restrict persons from the auction for certain reasons.
16. This agreement shall be governed by and construed in accordance with the laws of Germany. The UN Convention (CISG) on the International Sale of Goods shall not apply. Against traders (§ 14 BGB) and purchasers from abroad the exclusive jurisdiction shall be the Court of Kassel in relation to any dispute or claim arising out of or in connection with the purchase. The German version of these conditions shall be the legally binding. An invalid clause shall be replaced by a valid one which comes as close as possible to the economic content and purpose of the invalid clause. The same applies to a loophole. If the auction terms are available in several languages, the German version shall always prevail.
