Standard Terms

This service is operated by Redpoint Consulting Limited.

The services provided by Redpoint Consulting Limited ("Redpoint") through the Website ("Service" or "Services") and the use of the Website are governed by these Terms and Conditions ("Terms and Conditions"). By accessing or using the Services or the Website or by registering as a bidder ("Bidder" or "User"), you agree that

  1. You have read the Terms and Conditions,
  2. You understand the Terms and Conditions, and
  3. Your use of the Services and the Website will be in accordance with the Terms and Conditions.

If you do not agree to the Terms and Conditions, you may not access or use the Services or the Website.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this contract or its subject matter or formation (including non-contractual disputes or claims)

The Terms and Conditions together with any additional terms and conditions specific to a particular auction constitute the entire agreement (the "Agreement") between Redpoint and User  and replace any earlier version of the Terms and Conditions.

Redpoint may amend  the Terms and Conditions at any time, at Redpoint's sole discretion, without notice. Any amendment of the Terms and Conditions will be displayed on the Website.  Use of the Services and the Website constitutes an acceptance of the current Terms and Conditions.

Role of Redpoint.

Redpoint provides the Services and the Website only as a service for auctioneers ("Sellers") who offer for sale items and Bidders may may bid these items. Redpoint is neither a principal with interest in the transactions, nor an agent of Bidder or Seller. Redpoint does not make, and should not be construed as having made, any representation or warranty of any kind concerning any of the offered assets or offerings, including without limitation any representation or warranty regarding the quality, safety or legality of the offered assets, or the truth or accuracy of any offerings.

Redpoint makes no representation or warranty of any kind as to the ability of either Bidder or Seller to complete a sale in accordance with these Terms and Conditions or otherwise, and in accordance with any additional terms and conditions specific to a particular auction.

Redpoint does not have the power to transfer title of any assets offered by Sellers.

Redpoint may at its sole discretion to block any User who does not comply with the Terms and Conditions.

In the event of any dispute regarding any transaction conducted through use of the Services or the Website the User hereby releases Redpoint, its partners and subsidiaries, and their respective directors, employees, agents and successors in title and each of the foregoing, from any and all manner of action or claim  and from any and all losses, damages, costs or expenses, including without limitation court costs and legal fees, which User may have against the Released Parties.

In particular, Redpoint shall not be held responsible for any loss, damage or cost or expense arising from the use of the Service, or in Redpoints' failure to provide The Service. The Service is not guaranteed to be error free or to be available at any time.

DROIT APPLICABLE

Les présentes conditions sont réputées être acceptées, sans réserve, du fait de la participation à la vente aux enchères. Elles font partie intégrante de tout contrat de vente conclu dans le cadre de la vente aux enchères. Les présentes conditions de vente ont été établies en français et en anglais, en cas de divergence, seul le texte français fait foi.

Les conditions de vente suivantes sont régies par le droit monégasque, tout litige relève de la compétence exclusive des juridictions de la Principauté de Monaco.

GARANTIES

L’authenticité des lots est garantie par MDC sans réserve et sans limitation dans le temps.

ENREGISTREMENT

En vue d’une bonne organisation, les acquéreurs potentiels sont invités à remettre à MDC un formulaire d’enregistrement complété et signé ainsi qu’une pièce d’identité officielle. MDC peut exiger une référence bancaire et/ou une garantie. MDC se réserve le droit de ne pas laisser une personne participer à la vente aux enchères sans justification de sa part.

Les données personnelles qui auront été transmises lors de l’enregistrement seront reportées à l’identique sur le bordereau d’adjudication à défaut d’indications préalables contraires. Toute fausse indication engagera la responsabilité de l’acheteur.

ORDRES D’ACHAT ET RÉSERVATION DE LIGNE DE TÉLÉPHONE

Vous pouvez enchérir en étant présent dans la salle de vente, toutefois MDC pourra accepter des acquéreurs potentiels la réservation d'une ligne de téléphone ou un ordre d’achat écrit. Ils devront être accompagnés d’une pièce d’identité en cours de validité. MDC décline toute responsabilité en cas d’erreur ou d’omission dans le cadre de ce service.

ENCHÈRES EN LIGNE

Vous pouvez également enchérir en ligne en vous connectant sur les sites www.biddr.ch/auctions/mdcmonaco/ ou www.drouotlive.com.

REPRÉSENTATION

Tout enchérisseur est réputé agir en son nom propre, il est personnellement responsable du paiement, frais, taxes et commissions compris, des objets qui lui sont adjugés. L’enchérisseur peut toutefois agir au nom d’un tiers, à la seule condition que les pouvoirs qui lui ont été confiés figurent sur une procuration signée par le représenté, sous réserve d’acceptation par MDC.

ADJUDICATION

LES PRIX FIGURANT SUR LE CATALOGUE SONT DES PRIX DE DÉPART. La vente se fait au comptant, la devise utilisée est l’euro (€). Si MDC reçoit plusieurs ordres pour des montants identiques, les offres formulées par écrit sont prioritaires et ceci dans l'ordre d'arrivée.

PAIEMENT

En sus du prix d’adjudication, l’acheteur devra acquitter des frais de 17% HT (20,4% TTC), en cas d’achat via le live bidding cette commission sera de 20% HT (24% TTC).

Le paiement est exigible au plus tard 30 jours ouvrés après la vente, une pénalité de retard de 1% par mois sera facturée au-delà de ce délai.

Les frais d’envoi et d’assurance sont à la charge et au risque de l’acheteur.

Toutes les taxes dues à l’étranger sont entièrement à la charge de l’acheteur, il lui incombe de vérifier préalablement à l’achat les règles en vigueur dans le pays de destination. MDC décline toute responsabilité pour les éventuelles infractions à l’encontre de ces directives.

L’acquéreur doit régler le prix d’achat qui comprend le montant de l’adjudication augmenté des frais à la charge de l’acheteur et de tout impôt ou taxe éventuels :

- par virement bancaire en euro, frais bancaires à la charge de l'acheteur,

- par chèque, le lot ne sera délivré qu’après encaissement définitif du chèque,

- en espèces en euro jusqu’à 30 000 €,

- par CB le montant total sera majoré de 1,5% (frais bancaires).

Le lot ne sera délivré à l’acquéreur qu’après paiement intégral du prix, des frais et des taxes.

 

GENERAL CONDITIONS FOR AUCTION SALE

GOVERNING LAW AND JURISDICTION

These conditions are deemed accepted without reserve by any person attending the auction sale. They are part of any sales contract set with the auction house MDC. The French version of these general conditions shall prevail.

These conditions shall take effect in accordance with Monaco’s laws; all disputes and differences will be settled under the exclusive jurisdiction of the Monaco Principality’s court.

GUARANTEE

The authenticity of the coins and medals is guaranteed for the total purchase price, with no time limit.

MANDATORY REGISTRATION

Any potential buyers must register with MDC prior to the beginning of the auction sale by filing and signing the registration form and showing an identity card or passport. MDC may require bank reference and/or a guarantee. MDC reserves the right to refuse access to the auction sale to anybody for due reasons.

Those contact details given will be transcribed as is for invoicing, any false details are under the buyer’s responsibility.

ABSENTEE BID FORM AND TELEPHONE BID

MDC will accept absentee bid form and telephone bids completed with an identity card or passport copy and a bank account number. MDC disclaims all liability in this regard.

LIVE BIDDING

REPRESENTATION

Bidders are deemed to act in their own name, they are personally liable to the payment of the purchase price, of all costs, taxes and commissions in relation with the goods they purchase. Bidders may however act in the name of a third party, subject to the condition that their powers are documented through a proxy signed by the third party and that the latter has been identified and accepted by MDC.

AUCTIONING

THE PRICES LISTED ON THE CATALOG ARE THE STARTING PRICES. The higher bid gets the auction. Where several bids are on the same lot for an identical amount, bids submitted in writing have priority, otherwise the first bid order shall prevail.

PAYMENT

In addition to the auction price, the bidder will have to remit MDC a 17% commission (20.4% VAT included), in case of purchase via live bidding this commission will be 20% (24% VAT included).

The auctioneer may levy a 1% monthly interest in case of delayed settlement.

The shipping and handling fees are under the bidder’s responsibility.

Any taxes due abroad, including but not limited to customs duties and taxes are to be fully borne by the buyer. Buyer must comply with any customs regulations, foreign currency exchange regulations and any other regulations abroad. MDC has no responsibility whatsoever for any damage resulting from the breach of such regulations.

The settlement of auction price, costs, taxes and commission to MDC is due immediately upon delivery or prior to the shipment of the goods in euro (€) by:

- Bank transfer, bank fees at the buyer's expense.

- Check, the lots will be delivered under reserve MDC account is credited.

- Cash up to € 30,000.

- Credit card for convenience charge of 1,5% at the buyers expense.

The lot will be delivered to the buyer after full payment of the price, costs and taxes.
