The services provided by Redpoint Consulting Limited ("Redpoint") through the Website ("Service" or "Services") and the use of the Website are governed by these Terms and Conditions ("Terms and Conditions"). By accessing or using the Services or the Website or by registering as a bidder ("Bidder" or "User"), you agree that
- You have read the Terms and Conditions,
- You understand the Terms and Conditions, and
- Your use of the Services and the Website will be in accordance with the Terms and Conditions.
If you do not agree to the Terms and Conditions, you may not access or use the Services or the Website.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this contract or its subject matter or formation (including non-contractual disputes or claims)
The Terms and Conditions together with any additional terms and conditions specific to a particular auction constitute the entire agreement (the "Agreement") between Redpoint and User and replace any earlier version of the Terms and Conditions.
Redpoint may amend the Terms and Conditions at any time, at Redpoint's sole discretion, without notice. Any amendment of the Terms and Conditions will be displayed on the Website. Use of the Services and the Website constitutes an acceptance of the current Terms and Conditions.
Role of Redpoint.
Redpoint provides the Services and the Website only as a service for auctioneers ("Sellers") who offer for sale items and Bidders may may bid these items. Redpoint is neither a principal with interest in the transactions, nor an agent of Bidder or Seller. Redpoint does not make, and should not be construed as having made, any representation or warranty of any kind concerning any of the offered assets or offerings, including without limitation any representation or warranty regarding the quality, safety or legality of the offered assets, or the truth or accuracy of any offerings.
Redpoint makes no representation or warranty of any kind as to the ability of either Bidder or Seller to complete a sale in accordance with these Terms and Conditions or otherwise, and in accordance with any additional terms and conditions specific to a particular auction.
Redpoint does not have the power to transfer title of any assets offered by Sellers.
Redpoint may at its sole discretion to block any User who does not comply with the Terms and Conditions.
In the event of any dispute regarding any transaction conducted through use of the Services or the Website the User hereby releases Redpoint, its partners and subsidiaries, and their respective directors, employees, agents and successors in title and each of the foregoing, from any and all manner of action or claim and from any and all losses, damages, costs or expenses, including without limitation court costs and legal fees, which User may have against the Released Parties.
In particular, Redpoint shall not be held responsible for any loss, damage or cost or expense arising from the use of the Service, or in Redpoints' failure to provide The Service. The Service is not guaranteed to be error free or to be available at any time.
Auction House Terms
VERSTEIGERUNGSBEDINGUNGEN
Die Versteigerung erfolgt im Auftrag der Eigentümer unter Einhaltung der sich aus der Versteigerungsverordnung ergebenden gesetzlichen Bestimmungen gegen Bezahlung des Kaufpreises in Euro. Der Kaufpreis ist der Betrag des Meistgebots zuzüglich eines Aufgeldes von 15% und der gesetzlichen Mehrwertsteuer 19% und ist mit dem Zuschlag fällig. Bei Zahlungsverzug werden Zinsen von 1% pro Monat berechnet.Um diese erhöhte Steuerbelastung zu mindern wenden wir die Differenzbesteuerung nach §25a UstG an und berechnen dabei ein Aufgeld von 25% inklusive Versandkosten. Bei Abholung der Lose und sofortiger Bezahlung ist dieses Aufgeld auf 23% reduziert.
Der Zuschlag erfolgt im Saal nach Aufruf des höchsten Gebotes und verpflichtet zur Abnahme. Der Auktionator ist berechtigt, den Zuschlag aufzuheben oder bei etwaigen Meinungsverschiedenheiten über den Zuschlag das Los nochmals auszurufen, weiters Katalognummern zu vereinigen oder zu trennen. Eine Vorausnahme einzelner Stücke erfolgt nicht. Der Zutritt zur Versteigerung ist nur Interessenten gestattet, die einen Katalog besitzen.
Schriftliche Aufträge werden ohne Auftragsprovision erledigt. Bei gleichhohen schriftlichen Geboten wird das zuerst vorliegende berücksichtigt. Es werden nur Gebote in Euro angenommen. Aufträge von unbekannten Sammlern können nur ausgeführt werden, wenn ein Depot hinterlegt wird oder Referenzen angegeben werden. Bankspesen gehen zu Lasten des Käufers. Drittland-Ausländer kaufen nach den Devisenbestimmungen ihres Landes und erhalten die Lieferung mehrwertsteuerfrei, wenn der Versand durch uns erfolgt, bzw. der Export nachgewiesen wird.
Die Echtheit der Stücke ist gewährleistet, die Katalogbeschreibung ist sorgfältig erfolgt.
Die Bestimmungen, Beschreibungen und Erhaltungsangaben sind keine zugesicherten Eigenschaften. Berechtigte Beanstandungen können nur innerhalb 8 Tagen nach Erhalt der Lose durch den Käufer berücksichtigt werden. Alle Beanstandungen sind ausgeschlossen, wenn der Käufer bei der Auktion anwesend war. Erhaltungsgrad-Beanstandungen werden nicht anerkannt, da die Möglichkeit der Besichtigung sowohl vor als auch während der Auktion gegeben ist. Auf Wunsch der Einlieferer werden keine Ansichtssendungen vorgenommen. Alle Stücke werden mit digital erstelltem Bildzertifikat ausgeliefert.
Bis zur vollständigen Bezahlung aller sich ergebenden Forderungen gilt der Eigentumsvorbehalt. Gerichtsstand und Erfüllungsort für Kaufleute und das Mahnverfahren ist München. Im übrigen gelten die Bestimmungen der Versteigerungsverordnung, der Versicherungsvorschriften und Versteigerungsbedingungen.Durch Abgabe eines Gebotes werden die vorstehenden Versteigerungsbedingungen anerkannt.
Die im Katalog angegebenen Preise sind Schätzpreise. Gebote, die das Mindestgebot von 60% dieser Schätzpreise unterschreiten, werden nicht angenommen. Auf der Auktion unverkaufte Lose können nach der Auktion um 80% des Schätzpreises zuzüglich Aufgeld und MwSt. erworben werden. Die Ergebnisliste ist im Katalogpreis enthalten. Einzelergebnisse können nicht mitgeteilt werden. Alle Ergebnisse sind gratis im Internet auf www.lanz.com abrufbar.

TERMS OF SALE
The purchase price plus an additional charge of 15% and the VAT of 19% is due after adjudication and is payable in Euro immediately against delivery of the goods. Title does not pass until the goods are paid. Customers outside of the EU do not pay VAT, if goods are sent by us. To reduce this VAT burden we use the special margin scheme according §25a UstG in which case the surcharge will be 25% including shipping and insurance. If customers pick up the lots and pay on the spot this surcharge will be reduced to 23%. It is the responsibility of the buyer to comply with foreign customs and exchange regulations. Persons unknown to the auctioneer are requested to make themselves known before the sale. The descriptions given in this catalogue are set out in all good faith. The authenticity of the lots is warrantied. All items are accompanied by a digital photocertificate. Objections can only be considered within eight days from the receipt of the goods. If any legal action should arise, the court in Munich has jurisdiction for both parties. Every buyer is personally liable for all purchases made; he cannot claim to act for a third person. Bids in writing or bids in the sale are taken to imply the acceptance of the above terms of the sale. The auctioneer will execute orders on the usual conditions without any further charges. In other respects the conditions are those customary for auction sales held in Germany. The prices given in this catalogue are estimates in Euro. At the sale we accept a minimum bid of 60% of the estimate. After the sale unsold lots may be purchased at 80% of estimate plus fees. The list of prices realized will be available on our internet homepage www.lanz.com free of charge and the printed list will be mailed after the sale and is included in the catalogue price.

En ce cas la majoration est de 25% envoi inclus. En cas de enlévement et paiement immédiat cette majoration est réduit à 23%. Toutes taxes perçues à l’étranger telles que les impôts et les droits de douane sont par conséquent entièrement à la charge de l’acheter. Les nouveaux clients qui désirent participer à la vente, sont priés de se faire connaître auparavant. Les indications et les descriptions des lots sont données en toute science et conscience. L’authenticité des pièces est garantie. Toutes les pièces sont délivrées avec un certificat comportant une photo numérique. Les contestations justifiées ne peuvent être prises en considération que si elles sont formulées dans les huit jours qui suivent la réception des lots. En cas de litige, les deux parties se soumettront à la juridiction du tribunal de Munich. Tout acheteur est responsable des offres effectuées en son nom. Il ne peut prétendre avoir agi pour le compte d’un tiers. Une enchère donnée à la vente ou par ecrit implique la connaissance du règlement de vente. Les ordres d’achat seront exécutés aux conditions habituelles, sans aucun frais supplémentaire. En outre, les conditions de vente aux enchères ordinairement en usage en Allemagne seront appliquées.
