The services provided by Redpoint Consulting Limited ("Redpoint") through the Website ("Service" or "Services") and the use of the Website are governed by these Terms and Conditions ("Terms and Conditions"). By accessing or using the Services or the Website or by registering as a bidder ("Bidder" or "User"), you agree that

  1. You have read the Terms and Conditions,
  2. You understand the Terms and Conditions, and
  3. Your use of the Services and the Website will be in accordance with the Terms and Conditions.

If you do not agree to the Terms and Conditions, you may not access or use the Services or the Website.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this contract or its subject matter or formation (including non-contractual disputes or claims)

The Terms and Conditions together with any additional terms and conditions specific to a particular auction constitute the entire agreement (the "Agreement") between Redpoint and User  and replace any earlier version of the Terms and Conditions.

Redpoint may amend  the Terms and Conditions at any time, at Redpoint's sole discretion, without notice. Any amendment of the Terms and Conditions will be displayed on the Website.  Use of the Services and the Website constitutes an acceptance of the current Terms and Conditions.

Role of Redpoint.

Redpoint provides the Services and the Website only as a service for auctioneers ("Sellers") who offer for sale items and Bidders may may bid these items. Redpoint is neither a principal with interest in the transactions, nor an agent of Bidder or Seller. Redpoint does not make, and should not be construed as having made, any representation or warranty of any kind concerning any of the offered assets or offerings, including without limitation any representation or warranty regarding the quality, safety or legality of the offered assets, or the truth or accuracy of any offerings.

Redpoint makes no representation or warranty of any kind as to the ability of either Bidder or Seller to complete a sale in accordance with these Terms and Conditions or otherwise, and in accordance with any additional terms and conditions specific to a particular auction.

Redpoint does not have the power to transfer title of any assets offered by Sellers.

Redpoint may at its sole discretion to block any User who does not comply with the Terms and Conditions.

In the event of any dispute regarding any transaction conducted through use of the Services or the Website the User hereby releases Redpoint, its partners and subsidiaries, and their respective directors, employees, agents and successors in title and each of the foregoing, from any and all manner of action or claim  and from any and all losses, damages, costs or expenses, including without limitation court costs and legal fees, which User may have against the Released Parties.

In particular, Redpoint shall not be held responsible for any loss, damage or cost or expense arising from the use of the Service, or in Redpoints' failure to provide The Service. The Service is not guaranteed to be error free or to be available at any time.

Conditions générales.

1.  Ceci est une vente aux enchères par internet organisée conjointement par Langerman Diamonds. (ci-après dénommé Langerman) et son partenaire Redpoint Consulting Limited (ci-après dénommé Redpoint ou wwww.live-bidder.com).
Les présentes conditions générales de vente s’appliquent à toutes personnes participant aux ventes aux enchères conclues sur le site internet www.live-bidder.com. Faire une offre d’achat ou une enchère implique l’acceptation intégrale des présentes conditions de vente.

2.  Chaque personne désirant participer à la vente en Live ou placer des ordres d’achat avant la vente via Redpoint doit être enregistrée sur le site dans la section réservée à Langerman. Il est conseillé de s’inscrire au plus tard 12 heures avant la vente afin que les références commerciales puissent être vérifiées et l’enregistrement validé.

3.  Les enchères sont effectuées en euro. La vente suit l’ordre des numéros du catalogue. Les prix indiqués au catalogue sont les « prix de départ ».
Durant la vente, le prix de départ est déterminé en fonction des ordres d’achat reçus avant la vente et du prix de départ mentionné dans le catalogue. Ainsi, les prix de départ peuvent être supérieurs aux prix de départ mentionné dans le catalogue.
Les ordres d’achat inférieurs au prix de départ mentionné dans le catalogue ne seront pas pris en considération.
Langerman et Redpoint se réservent le droit, à tout moment et à leur entière discrétion, de refuser une enchère, de retirer un lot ou de le rouvrir sans en donner la raison.
Le lot sera adjugé à l’enchère la plus haute et oblige l’acheteur à accepter les lots au prix d’adjudication incrémenté des taxes et frais applicables.
Durant la vente, le message ‘Fair Warning’ est clairement affiché sur l’écran de l’enchérisseur pendant quelques secondes. A l’extinction de ce message, le lot est adjugé. L’enchérisseur est ainsi encouragé à placer sa dernière enchère dès l’apparition du message ‘Fair Warning’. Le placement d’une enchère durant l’apparition de ce message annule ce dernier qui réapparaîtra quelques secondes plus tard. L’adjudication sera attribuée par préférence par ordre de réception et d’acceptation des offres.

4.  Des ordres d’achat peuvent être placés avant la vente soit par email, par fax ou via le site Redpoint (les conditions générales de Redpoint doivent être acceptées lors de l’enregistrement en complément des présentes conditions générales).
Les ordres d’achat placés avant la vente par courrier fax ou email doivent nous parvenir au plus tard 4 heures avant la vente. Les ordres écrits placés via le site Redpoint sont acceptés jusqu’à 2 heures avant la vente.
Aucun ordre d’achat ne peut être annulé une fois que la vente a débuté.
En cas d’ordres placés par une personne inconnue de Langerman, de Redpoint ou de l’un de leur partenaires, Langerman et Redpoint se réservent le droit de refuser un ordre d’achat ou de demander un acompte à l’enchérisseur.
L’ordre d’achat ou la mise en Live impliquent l’acceptation inconditionnelle de l’achat du lot concerné au prix d’adjudication incrémenté des différents frais et taxes éventuels.

5.  Commissions et taxes :
Une commission acheteur de 8% du prix d’adjudication est ajoutée au montant facturé du ou des lot(s) acquis et fait partie intégrante du montant dû.
Le paiement est dû en euros immédiatement après l’adjudication. Les lots ne seront envoyés ou remis qu’après le paiement intégral de la facture. Le délai maximum de paiement est de 30 jours à compter de l’émission de la facture.
Un intérêt de retard de 1% par mois sera perçu sur l’ensemble du montant facturé pour tout retard de paiement.

6.  L’acheteur est personnellement responsable de son ou ses achat(s) et agit par conséquent en son nom propre et ne peut prétendre avoir agi pour le compte d’un tiers. Il est personnellement responsable du paiement du ou des lot(s) adjugés, des frais, des taxes, des commissions et frais de livraison ou bancaires.

7. L'envoi des lots adjugés sera effectué, après paiement, aux frais de l'acheteur.
Le transfert de propriété du ou des lots adjugés ne sera effectif qu’après paiement intégral du prix d’adjudication et des frais additionnels. Toutefois, dès l’adjudication, tous les risques afférents au(x) lot(s) adjugé(s) seront transférés à l’adjudicataire dans leur intégralité et sans la moindre réserve. Toutes les taxes exigibles à l’étranger (taxes de douane, impôts, etc.) sont entièrement à la charge de l’acheteur.

8.  L’authenticité des lots est garantie. La description de chaque lot a été établie rigoureusement par nos experts et est donnée en toute conscience et bonne foi. Toute éventuelle réclamation dument justifiée doit être adressée dans les 14 jours suivant la réception des lots.
Tous les lots pourront être examinés personnellement, ou par l’intermédiaire d’un représentant, dans nos locaux et sur rendez-vous uniquement.

9.  Tout litige découlant des présentes conditions générales est de la compétence exclusive des tribunaux d’arrondissement de Bruxelles.
Toutefois Langerman et Redpoint se réservent la faculté de saisir les tribunaux du domicile de l’acheteur.
En cas de litige, seule la version française des présentes conditions générales fait foi.

Terms and conditions (Automatic translation).

2. Every person wishing to participate in the live auction or place buy orders prior to the sale via Redpoint must be registered on the site in the section reserved for Langerman. It is advisable to register no later than 12 hours before the sale so that the commercial references can be verified and the registration validated.

3. Auctions are made in euros. The sale follows the order of the catalog numbers. The prices listed in the catalog are the "starting prices".
During the sale, the starting price is determined according to the purchase orders received before the sale and the starting price mentioned in the catalog. Thus, starting prices may be higher than the starting prices mentioned in the catalog.

During the sale, the message 'Fair Warning' is clearly displayed on the bidder's screen for a few seconds. At the end of this message, the lot is awarded. The bidder is thus encouraged to place his last bid at the appearance of the message 'Fair Warning'. Placing a bid during the appearance of this message cancels the latter, which will reappear a few seconds later. The contract will be awarded by preference in order of receipt and acceptance of tenders.

4. Purchase orders may be placed before the sale either by email, fax or via the Redpoint site (the General Terms and Conditions of Redpoint must be accepted at registration in addition to these terms and conditions).
Purchase orders placed before the sale by fax or email must reach us no later than 4 hours before the sale. Written orders placed via the Redpoint site are accepted until 2 hours before the sale.
No purchase order can be canceled once the sale has started.
In the case of orders placed by a person unknown to Langerman, Redpoint or one of their partners, Langerman and Redpoint reserve the right to refuse a purchase order or to request a down payment from the bidder.
The purchase order or the Live bet implies the unconditional acceptance of the purchase of the lot concerned at the award price incremented by the various fees and taxes.

5. Commissions and taxes:
A commission of 8% of the hammer price is added to the invoiced amount of the lot (s) acquired and is an integral part of the amount due.
Payment is due in euros immediately after the auction. The lots will be sent or delivered only after full payment of the invoice. The maximum payment period is 30 days from the issuance of the invoice.
A late payment interest of 1% per month will be charged on the entire amount invoiced for any late payment.

6. The buyer is personally responsible for his purchase (s) and therefore acts in his own name and can not claim to have acted on behalf of a third party. He is personally responsible for the payment of the lot (s) awarded, fees, taxes, commissions and shipping or bank charges.

7. The sending of the awarded lots will be done, after payment, at the expense of the buyer.
The transfer of ownership of the lot (s) awarded will only be effective after full payment of the hammer price and additional costs. However, from the moment of the award, all the risks relating to the lot (s) awarded will be transferred to the successful tenderer in their entirety and without the slightest reservation. All taxes due abroad (customs duties, taxes, etc.) are entirely the responsibility of the buyer.

8. The authenticity of the lots is guaranteed. The description of each lot has been rigorously established by our experts and is given in good conscience and good faith. Any possible claim duly justified must be made within 14 days of receipt of the lots.
All lots can be examined personally, or through a representative, on our premises and by appointment only.

9. Any dispute arising from these terms and conditions is the exclusive jurisdiction of the district courts of Brussels.
However, Langerman and Redpoint reserve the right to seize the courts of the buyer's domicile.
In case of dispute, only the French version of these terms and conditions prevails.
