The services provided by Redpoint Consulting Limited ("Redpoint") through the Website ("Service" or "Services") and the use of the Website are governed by these Terms and Conditions ("Terms and Conditions"). By accessing or using the Services or the Website or by registering as a bidder ("Bidder" or "User"), you agree that
- You have read the Terms and Conditions,
- You understand the Terms and Conditions, and
- Your use of the Services and the Website will be in accordance with the Terms and Conditions.
If you do not agree to the Terms and Conditions, you may not access or use the Services or the Website.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this contract or its subject matter or formation (including non-contractual disputes or claims)
The Terms and Conditions together with any additional terms and conditions specific to a particular auction constitute the entire agreement (the "Agreement") between Redpoint and User and replace any earlier version of the Terms and Conditions.
Redpoint may amend the Terms and Conditions at any time, at Redpoint's sole discretion, without notice. Any amendment of the Terms and Conditions will be displayed on the Website. Use of the Services and the Website constitutes an acceptance of the current Terms and Conditions.
Role of Redpoint.
Redpoint provides the Services and the Website only as a service for auctioneers ("Sellers") who offer for sale items and Bidders may may bid these items. Redpoint is neither a principal with interest in the transactions, nor an agent of Bidder or Seller. Redpoint does not make, and should not be construed as having made, any representation or warranty of any kind concerning any of the offered assets or offerings, including without limitation any representation or warranty regarding the quality, safety or legality of the offered assets, or the truth or accuracy of any offerings.
Redpoint makes no representation or warranty of any kind as to the ability of either Bidder or Seller to complete a sale in accordance with these Terms and Conditions or otherwise, and in accordance with any additional terms and conditions specific to a particular auction.
Redpoint does not have the power to transfer title of any assets offered by Sellers.
Redpoint may at its sole discretion to block any User who does not comply with the Terms and Conditions.
In the event of any dispute regarding any transaction conducted through use of the Services or the Website the User hereby releases Redpoint, its partners and subsidiaries, and their respective directors, employees, agents and successors in title and each of the foregoing, from any and all manner of action or claim and from any and all losses, damages, costs or expenses, including without limitation court costs and legal fees, which User may have against the Released Parties.
In particular, Redpoint shall not be held responsible for any loss, damage or cost or expense arising from the use of the Service, or in Redpoints' failure to provide The Service. The Service is not guaranteed to be error free or to be available at any time.

1) Préambule :
La présente vente aux enchères par internet est organisée par :
tradart
mmb sa, 294 avenue Molière, B-1180 Bruxelles (ci-après « tradart »)
et
son partenaire,
Redpoint Consulting Limited
(ci-après dénommé Redpoint ou wwww.live-bidder.com).
Les
présentes conditions générales de vente s’appliquent à toutes personnes
participant aux ventes aux enchères de monnaies et médailles de tradart conclues sur le site internet www.live-bidder.com. Faire une offre
d’achat ou une enchère implique l’acceptation intégrale et inconditionnelle des
conditions de vente suivantes.
2) Enregistrement et admission :
Toute personne désirant participer à la vente en Direct ou placer des ordres
d’achat avant la vente via Redpoint doit, au préalable, s’enregistrée sur le
site dans la section réservée à Nom
usuel de la société. Il est conseillé de s’inscrire au plus tard 12
heures avant la vente afin que les références commerciales puissent être
vérifiées.
3) Les ordres d’achat :
Des ordres d’achat peuvent être placés avant la vente soit par email, soit
via le site Redpoint ; le fonctionnement complet et parfait de ce site
internet ne peut être garantit par tradart.
Les ordres d’achat sont acceptés jusqu’à 12 heures avant le début de la vente.
En cas d’ordres d’achat placés par une personne inconnue de tradart ou de ses partenaires, tradart se réserve le
droit de refuser les ordres en question ou de demander un acompte à
l’enchérisseur.
L’ordre d’achat implique l’acceptation inconditionnelle de l’achat du
lot concerné augmenté des différents frais et taxes éventuels, et ceci, au
minimum à la valeur du prix de départ mentionné dans le catalogue s’il n’y a pas d’autre enchérisseurs. Si nous disposons de votre adresse email, vous
recevrez une confirmation de la réception de votre ordre d’achat en retour.
4) Déroulement des enchères :
Les enchères sont effectuées en Euro. La vente suit l’ordre des numéros
du catalogue. Les prix indiqués au catalogue sont les « prix de
départ ». Durant la vente, les prix de départ peuvent être supérieurs au
prix de départ mentionné dans le catalogue en fonction des ordres d’achat reçus
avant la vente. Les ordres d’achat inférieurs au prix de départ ne seront pas pris
en considération. tradart se réserve le
droit, à tout moment et à son entière discrétion, de refuser une enchère, de
retirer un lot ou de le rouvrir.
Le lot sera adjugé à l’enchère la plus haute et oblige l’acheteur à accepter
les lots au prix d’adjudication incrémenté des taxes et frais applicables.
Durant la vente, le message ‘Fair
Warning’ est clairement affiché sur l’écran de l’enchérisseur pendant
quelques secondes. A l’extinction de ce message, le lot est adjugé.
L’enchérisseur est ainsi encouragé à placer sa dernière enchère dès
l’apparition du message ‘Fair Warning’.
Le placement d’une enchère durant l’apparition de ce message annule ce dernier
qui réapparaîtra quelques secondes plus tard. L’adjudication sera attribuée par
préférence selon l’ordre de réception et d’acceptation des offres.
5) Commissions, taxes et frais
annexes :
Une
commission acheteur de 22% sur le prix d’adjudication, TVA incluse, est ajoutée au montant du ou des
lot(s) facturés et fait partie intégrante du montant dû.
Cette commission acheteur est
réduite à 18 % pour les acquéreurs dont les acquisitions seront exportées hors
de la communauté européenne.
La totalité du prix d’achat en euros, commission
acheteur incluse, est due immédiatement après l’adjudication.
Les lots ne seront envoyés ou remis à l’acheteur qu’après le paiement
intégral de la facture. Le délai maximum de paiement est de 30 jours à compter
de la date d’émission de la facture.
Au-delà, un intérêt de retard de 1% par mois sera perçu pour tout retard
de paiement.
6) Modes de paiement :
Les modes de paiement acceptés sont :
- le virement sur le compte bancaire de tradart,
- le virement sur le compte PayPal de tradart,
- le chèque bancaire certifié, à l’ordre de tradart,
- les cartes de crédit Visa et MasterCard
- les espèces pour toute facture inférieure à 3.000 euros.
Les paiements effectués par PayPal et par carte de crédit sont soumis à des
frais additionnels.
7) Responsabilité de l’acheteur :
Tout acheteur est responsable de l’achat effectué en son nom. Il ne peut
pas prétendre avoir agi pour le compte d’un tiers. Il est
personnellement responsable du paiement des lots qui lui ont été adjugés,
augmentés des commissions et taxes, ainsi que des autres frais annexes, frais bancaires,
et frais d’expédition mentionnés au point 8) ci-dessous.
Toutes les formalités et taxes exigibles à l’étranger (importation,
taxes de douane et impôts) sont entièrement de la responsabilité et à la charge
de l’acheteur.
8) Livraison des lots :
La remise des lots adjugés sera effectuée, après paiement. Le transfert de
propriété du ou des lots adjugés ne sera effectif qu’après paiement intégral du
prix d’adjudication et des frais additionnels mentionnés aux point 5) et 7)
ci-dessus. Toutefois, dès l’adjudication, tous les risques afférents aux lots
adjugés seront transférés à l’adjudicataire dans leur intégralité et sans la moindre
réserve.
L’acheteur est convié à retirer ses achats au plus tard dans les dix jours suivant
le paiement ; il pourra en prendre livraison au siège de tradart à Bruxelles, soit dans les trois
jours suivant la vente, de 14 :00 à 17:30, soit sur rendez-vous.
L’acheteur peut également demandé à ce que ses lots lui soient adressés par voie
postal ; dans ce cas, les lots lui seront alors adressés comme demandé ;
les frais d’expédition, de licence d’exportation, d’assurance lui seront
facturés.
9) Garantie de l’authenticité.
Le catalogage a été confectionné avec soin afin que les indications portées
soient correctes et dignes de foi. Celles-ci ne reflètent que l’opinion de tradart, qu’elle donne dans le cadre de
son mandat en toute science et conscience. La responsabilité de tradart ne saurait dès lors en aucun cas
être engagée de ce chef, à l’exception de l’authenticité, qui est garantie ;
toute
réclamation à ce titre ne peut être prise en considération qu’à la condition
qu’elle soit justifiée et présentée dans un délai de 14 jours calendrier
suivant la remise physique à l’acheteur - ou à un tiers désigné par lui et
dument mandaté.
10) Etat de conservation et défauts :
Tous les lots sont vendus dans l’état où ils se trouvent avec leurs
défauts, imperfections, et erreurs éventuelles de description ou de référence. tradart ne saurait être rendue
responsable des différences pouvant survenir entre l’objet et les mentions qui
le concernent dans le catalogue, ni des défauts que cet objet peut comporter.
Les acheteurs doivent s’assurer eux-mêmes avant la vente de l’état matériel de
chaque lot, notamment en ce qui concerne l’état de conservation, ou d’éventuels
défauts ou restaurations.
C’est pourquoi, tradart invite
expressément toute personne souhaitant participer aux enchères, ou son représentant, à
venir examiner les lots avant la vente, à notre adresse à Bruxelles, aux jours
et heures d’exposition spécifiés dans le catalogue, et/ou à consulter le
catalogue disponible en ligne sur internet.
11) Interprétation et exécution des conditions de
vente :
En cas de contradiction entre les diverses traductions des conditions de vente,
seul le texte français fera foi.
Les présentes conditions de vente sont soumises au droit belge. En cas de
litige les tribunaux de Bruxelles en Belgique seront seuls compétents ; toutefois tradart se réserve la faculté de saisir
les tribunaux du domicile de l’acheteur.

1) Preamble:
This Internet auction sale is organised by:
tradart
mmb sa, 294 avenue Molière, B-1180 Brussels (hereinafter “tradart”)
and its partner,
Redpoint Consulting Limited (hereinafter
Redpoint or www.live-bidder.com).
Theses general terms and conditions of sale apply to all persons participating
in tradart’s auction sales of
coins and medals concluded on the www.live-bidder.com website. Making a
purchase offer or a bid implies full and unconditional acceptance of the
following terms and conditions of sale.
2) Registration and Admission:
Any person wishing to participate in the Live sale or place purchase orders
before the sale via Redpoint must, in advance, register on the website in the
section reserved for Usual company
name. You are advised to register no later than 12 hours before the
sale so that the commercial references can be checked.
3) Purchase Orders:
Purchase orders may be placed before the sale either by email or via the
Redpoint website; tradart cannot
guarantee the complete and perfect operation of this website.
Purchase orders are accepted up to 12 hours before the start of the sale. Where
purchase orders are placed by a person unknown to tradart or its partners, tradart
reserves the right to refuse the orders in question or to request a deposit
from the bidder.
The purchase order implies the unconditional acceptance of the purchase
of the lot concerned plus the various charges and any taxes at the minimum value
of the starting price stated in the catalogue if
there are no other bidders. If we have your
email address, you will receive confirmation of receipt of your purchase order
in return.
4) Conduct of the Auctions:
The auctions are conducted in euros. The sale follows the order of the
catalogue numbers. The prices indicated in the catalogue are “starting prices”.
During the sale, the starting price may be higher than the starting price
mentioned in the catalogue depending on the orders received before the sale.
Purchase orders lower than the starting price will not be taken into
consideration. tradart reserves
the right at any time and at its sole discretion, to refuse a bid, to withdraw
a lot or to reopen it.
The lot will be sold for the highest bid and obliges the buyer to accept the
lots at the auction price increased by the applicable taxes and charges. During
the sale, the ‘Fair Warning’
message is clearly displayed on the bidder’s screen for a few seconds. When
this message is no longer displayed, the lot is sold.
The bidder is thus encouraged to place his last bid as soon the ‘Fair Warning’ message is
displayed. Placing a bid when this message is displayed cancels it and it will
reappear a few seconds later. The lot will be attributed by preference according
to the order of receipt and acceptance of the bids.
5) Commissions,
Fees and Ancillary Costs:
A buyer commission of 22% on the sale price, including VAT, is added to the amount of the
invoiced lot or lots and is an integral part of the amount due.
This buyer commission is
reduced to 18% for buyers whose acquisitions will be exported outside the
European Community.
The entire purchase price in euros, including the buyer commission, is due immediately after the auction.
The lots will only be sent or delivered to the buyer after payment in
full of the invoice. The maximum payment period is 30 days from the date of
issuance of the invoice.
After this period, late payment interest of 1% per month will be charged
for any late payment.
6) Payment Methods:
The payment methods accepted are:
- transfer to tradart’s
bank account
- transfer to tradart’s PayPal
account
- a certified bank cheque, payable to tradart,
- Visa and MasterCard credit cards
- cash for any invoice under 3,000 euros.
7) The Buyer’s Responsibility:
The buyer is responsible for the purchase made in his name. He cannot
claim to have acted on behalf of a third party. He
is personally responsible for the payment of the lots that have been sold,
increased by the commissions and taxes as well as the other ancillary costs,
bank charges, and shipping costs stated in point 8) below.
All the formalities and taxes payable abroad (import, customs duties and
taxes) are the buyer’s entire responsibility and borne by him.
8) Delivery of the Lots:
The lots sold will be delivered after payment. The transfer of ownership of the
lot or lots sold will be effective only after payment in full of the auction
price and the additional costs stated in points 5) and 7) above. However, as
soon as the sale has been made, all the risks relating to the lots sold will be
transferred to the successful bidder in their entirety and with no reservation.
The buyer is requested to collect his purchases no later than ten days
following payment; he may take delivery of them at the tradart headquarters in Brussels, either within three days following
the sale, from 14:00 to 17:30 or by appointment.
The buyer may also request that his lots be sent to him by post; in this case,
the lots will be sent as requested; the shipping costs, export licence and
insurance will be invoiced to him.
9) Guarantee of Authenticity.
The cataloguing process has been undertaken with care to ensure that the
information it contains is correct and trustworthy. It only reflects tradart’s opinion that it provides
within the context of its remit and to the best of its knowledge. tradart may therefore not be considered
responsible in this respect, with the exception of the authenticity, which is
guaranteed; any complaint in relation to this may only be taken into account
provided that it is justified and presented within 14 calendar days following
the physical delivery to the buyer - or to a third party designated by him and
duly authorised.
10) State of Conservation and Defects:
All lots are sold in their current condition with their defects,
imperfections and possible errors of description or reference. tradart may not be deemed responsible
for differences that may arise between the object and the particulars about it
in the catalogue, or defects that this object may contain. Buyers must ensure
before the sale that they are aware of the material condition of each lot, in
particular as regards the state of conservation or any defects or restorations.
That is why tradart expressly
invites any person wishing to participate in the auction, or his
representative, to come and examine the lots before the sale, at our address in
Brussels, on
the days and hours of display stated in the catalogue and/or to view the
catalogue available online on the Internet.
11) Interpretation and enforcement of the terms
and conditions of sale:
In the event of a contradiction between the various translations of the terms
and conditions of sale, only the French text will be considered authentic.
These terms and conditions of sale are governed by Belgian law. In the event of
a dispute, the courts of Brussels in Belgium alone
will have jurisdiction; however tradart reserves
the right to refer the matter to the courts of the buyer’s residence.
