Standard Terms

This service is operated by Redpoint Consulting Limited.

The services provided by Redpoint Consulting Limited ("Redpoint") through the Website ("Service" or "Services") and the use of the Website are governed by these Terms and Conditions ("Terms and Conditions"). By accessing or using the Services or the Website or by registering as a bidder ("Bidder" or "User"), you agree that

  1. You have read the Terms and Conditions,
  2. You understand the Terms and Conditions, and
  3. Your use of the Services and the Website will be in accordance with the Terms and Conditions.

If you do not agree to the Terms and Conditions, you may not access or use the Services or the Website.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this contract or its subject matter or formation (including non-contractual disputes or claims)

The Terms and Conditions together with any additional terms and conditions specific to a particular auction constitute the entire agreement (the "Agreement") between Redpoint and User  and replace any earlier version of the Terms and Conditions.

Redpoint may amend  the Terms and Conditions at any time, at Redpoint's sole discretion, without notice. Any amendment of the Terms and Conditions will be displayed on the Website.  Use of the Services and the Website constitutes an acceptance of the current Terms and Conditions.

Role of Redpoint.

Redpoint provides the Services and the Website only as a service for auctioneers ("Sellers") who offer for sale items and Bidders may may bid these items. Redpoint is neither a principal with interest in the transactions, nor an agent of Bidder or Seller. Redpoint does not make, and should not be construed as having made, any representation or warranty of any kind concerning any of the offered assets or offerings, including without limitation any representation or warranty regarding the quality, safety or legality of the offered assets, or the truth or accuracy of any offerings.

Redpoint makes no representation or warranty of any kind as to the ability of either Bidder or Seller to complete a sale in accordance with these Terms and Conditions or otherwise, and in accordance with any additional terms and conditions specific to a particular auction.

Redpoint does not have the power to transfer title of any assets offered by Sellers.

Redpoint may at its sole discretion to block any User who does not comply with the Terms and Conditions.

In the event of any dispute regarding any transaction conducted through use of the Services or the Website the User hereby releases Redpoint, its partners and subsidiaries, and their respective directors, employees, agents and successors in title and each of the foregoing, from any and all manner of action or claim  and from any and all losses, damages, costs or expenses, including without limitation court costs and legal fees, which User may have against the Released Parties.

In particular, Redpoint shall not be held responsible for any loss, damage or cost or expense arising from the use of the Service, or in Redpoints' failure to provide The Service. The Service is not guaranteed to be error free or to be available at any time.

Auction House Terms
TERMS OF SALE
 

We guarantee the authenticity of the pieces exhibited in this catalogue, unless otherwise indicated.

Participating implies the acceptance of the following conditions:

1. All sales are in exact amount of Euros. The prices indicated in the catalogue for each lot, are the minimum sale prices. Bids for a lower price than the one marked, are not accepted. Everyone who participates is responsible for the offers placed. The auctioneer is not responsible for mistakes in the offers. If during the auction any doubt arises about the last bidder, the lot will be put again in sale.

2. The final prices of sale will include a commission of 16% on the price of adjudication and on the V.A.T. at the legal rate.

3. The pieces will be sent through registered mail with reception’s form at buyer risk. Handling postage will be at buyer’s expenses.

4. Participate on the auction may be:

- By bidding directly in the auction room.

- By sending an offer, duly filled in, by postal mail, fax, email or phone (previously requested).

- By bidding directly through internet (Addition 2% over commission // Inscription limit 2 hours before the auction begins).

5. Lots will be awarded to the highest bidder, in case of equality preference will be given to the orders of non present buyers over the ones present: in the auction room, live internet and telephone, and from among the absent ones those received in first place.

6. Ways of payment: cash payment, bank transfer or check (in Euros). Any form of payment different from these must be communicated before. Numismática Leilões will keep in its possession the numismatic pieces until total liquidation.

7. With the entry into force of Law no. 83/2017, of August 18, which establishes Measures to Combat Money Laundering and Terrorist Financing, is NUMISMÁTICA NECTIT ET FIRMAT, LDA obliged to observe the procedures for identification and due diligence, whenever they establish business relations, namely transactions of an amount equal to or greater than € 15,000.00 (fifteen thousand euros), regardless of whether the transaction is carried out through a single operation or several operations.

Thus, in order to comply with Law no. 67/98, of October 26 - Law of Protection of Personal Data, you are informed that the personal data contained in Model 1 made available by Autoridade de SegurançaAlimentar e Económica(Food and Economic Security Authority) will be collected, which will be kept by NUMISMÁTICA NECTIT ET FIRMAT, LDA

As it is a legal obligation, if it is not allowed to NUMISMÁTICA NECTIT ET FIRMAT, LDA. the collection of the data, it can refuse to conclude the transaction and no liability could be imputed to the auctioneer - art. 50 of Law no. 83/2017 of 18 August.

8. Lots purchased must be picked up within 10 days after auction close. Numismática Leilões reserves itself the right to cancel the sale and to dispose of lots when payment is not done within 30 days after the auction.

9. If some numismatic piece has a flaw not described in the catalogue, the buyer can return it back in a maxi­mum of 10 days, starting from the day it was sent. The discrepancy in the degree of conservation will not be a reason for return, except proved error. Any returned piece must be in the same condition as it was de­livered. We do not accept returns of any object of present buyers during the auction, for it is supposed they would have examined the numismatic pieces in advance. Lots of sets can not be returned.

10. Sold lots can be collected from the day after the auction, at our office in D. Luíz de Noronha Street, n. º 26, 6º Esq. starting form 11.00 am. Lots sold to the absent buyers will be sent them after payment, in the days next to the auction sale.

11. Numismática Leilões reserves the right to change the auction due a force majeure cause, as well as to re­move any lot.

12. Lots not sold in auction can be acquired until 10 days after the end of auction, plus the sale commission and VAT at the legal rate.

13. In case of litigation, the text which obliges both parts to comply the terms is the one published in Portu­guese.

14. The participation in the auction implies the acceptance of the terms described before. Any litigation will be submitted to the courts of Lisbon, and the buyer resigns expressly any other jurisdiction that could cor­respond him.
